Conveyancing is the process of transferring ownership of legal title in land and it takes place whenever you’re buying or selling land. While it isn’t legally required, conveyancing is a complex task which includes various legal, financial and administrative steps. Consequently it is prudent to engage an experienced conveyancing lawyer to assist with the process.

Conveyancing broadly involves three steps:

Contract preparation
Exchange of contracts
Settlement of the transaction

If you’re selling a property, your conveyancing lawyer will:

Prepare the contract taking into account any unique circumstances that require additional and specialised clauses
Protect your interests when negotiating the final terms of sale with the buyer
Arrange for the exchange of contracts and payment of deposit
Liaise with your bank to determine the conditions for the discharge of any mortgage
Calculate the precise amount of money the buyer needs to pay on settlement (taking into account adjustments for rates, water and building reports etc)
Prepare documents to give effect to the transfer of ownership
Oversee the settlement of the transaction whereby purchase funds are handed over in exchange for title documents

If you’re buying property, your conveyancing lawyer will:

Review the contract for sale
Protect your interests when negotiating the final terms of the sale with the seller
Arrange for the exchange of contracts and payment of deposit
Liaise with your bank to help ensure finances will be ready in time for settlement
Undertake searches to determine what additional payments, if any, will be required on settlement for rates and water etc.
Calculate the precise amount of money you need to pay on settlement
Ensuring that the correct title documentation are handed over at settlement
